The passage of the Criminal Justice Reform Bill which is Chapter 4 of the “First Step Act” is a major change in the law. Many people could be released very soon, and others will have much shorter sentences when their cases are reviewed under the new law.
It is retroactive, which means the Court will review mandatory sentences, especially those who were sentenced as Career Offenders, and ‘three strikes” defendants. The new law will also give sentencing Judges more discretion in instituting mandatory sentences, and there will be focus on rehabilitation in prison before release.
Defendants can earn additional “good time credits” while in prison which also help with earlier release. These are huge changes, far more than the 2010 sentencing reforms which helped in the release and at least resentencing of thousands of crack defendants on due process and equal protection grounds, who were previously sentenced more harshly than their white counterparts who generally were sentenced for use of powder cocaine.
